Experience & Understanding

Legal translation English > Spanish

Legal translations are a complex and intellectual process. Some legal concepts and terms vary by country/jurisdiction representing separate concepts. Comprehensive knowledge of the legal issues relating to source and target texts is therefore essential. Not to mention that any mistranslation may have serious consequences, especially in the area of company law. It goes without saying, therefore, that the language used in legal matters and its accuracy are of crucial importance.

1 What does the legal translation include?

Legal translation covers a wide range of very varied documents. These can include legal documents such as summonses and arrest warrants; administrative texts such as registration certificates; company statutes and draft remittances; technical documents such as expert opinions and texts for judicial purposes; and a range of other texts as well as reports and minutes of court proceedings.

2. Legal or certified translation

Legal translations, which are not to be confused with certified translations, refer to the task of judicial translation. Judicial translators are specialised in the translation of documents such as requests for legal assistance, minutes of proceedings, judgements, expert opinions, depositions, interrogation transcripts, etc.

3. Translation of documents

Legal translation refers to legally binding documents. This could be, for example, the translation of documents such as laws; ordinances and decrees; general terms and conditions of sale and purchase; legally binding contracts such as employment contracts; licence and commercial contracts; partnership agreements, conventions; protocols and conventions; internal regulations; insurance policies; and bail bonds, among others. The legal translator must have a solid legal background in addition to linguistic training.

4. Sworn translation

A sworn translator can use their signature to authenticate official translations. These are usually documents that require legal validation and are therefore referred to as "certified". Sworn linguists often work in courtrooms as legal translators or act as legal experts, providing translations of civil status documentation, marriage contracts, divorce agreements, deeds of death and wills, for example.

5. Legal translation

However, different rules apply to legal translations than to most other translation work, because in the field of law, a technical and intellectual precision must be guaranteed that can only be provided by specialists. It makes no difference whether patent applications, rental agreements or sales contracts are to be translated, as even the smallest deviations from the original can distort the content of the contract.

6. Legalese

Legal language is a specialised jargon that is used in the fields of justice, administration and private legal transactions to optimise communication between experts. It includes both the language of legal norms (laws, ordinances, commentaries, etc.) and the administrative language used to implement laws (instructions, notices, reminders, etc.). In the case of legal language, laws must be "linguistically correct and as comprehensible as possible for everyone". However, they cannot be simplified at will, as legal precision and legal certainty must be guaranteed.
